A Romanian trademark is protected for ten years from the filing date and can be renewed indefinitely in ten-year terms. The renewal itself is a formality. Missing it is not — the right lapses, and a lapsed mark is not always recoverable.

The deadlines

  • Normal term: the renewal request may be filed during the last six months of the current ten-year period.
  • Grace period: a further six months after expiry, subject to a surcharge.
  • After the grace period: the registration lapses. The mark can be filed afresh, but as a new application with a new filing date — losing ten years of seniority and exposing the sign to anyone who filed in the interval.

What is at risk

Seniority is the substance of a trademark right. A mark filed in 2005 defeats one filed in 2015; the same mark refiled in 2026 does not. Losing the original date can mean losing an opposition you would otherwise have won, and it can invalidate the basic mark on which an international registration depends.

The renewal is an opportunity

Ten years is long enough for a business to have changed. Before renewing, it is worth checking:

  • Whether the classes still match what you sell. Classes you no longer trade in are vulnerable to non-use cancellation and cost money to maintain.
  • Whether classes are missing. New product lines are frequently outside the original specification. These require a new application, not a renewal.
  • Whether the sign in use is still the sign registered. A rebrand that altered the logo may mean the registered mark no longer protects what is actually on the market.
  • Whether the ownership details are current. Changes of company name, address or ownership should be recorded before renewal, not after.
