Registering a mark does not stop anyone from filing a similar one. Neither OSIM nor EUIPO will refuse a later application because your mark exists — they raise earlier rights only if the holder objects. Watching is how you find out in time to object.

The two-month problem

Opposition must be filed within two months of publication in Romania, three months at EUIPO. Both terms are preclusive. Miss them and the later mark proceeds to registration, after which your options narrow to cancellation proceedings — slower, more expensive, and with a higher evidential burden.

Nobody notifies you when a similar application is published. The publication is public, but finding it requires looking. That is the whole of the service.

  • Identical marks and similar signs, assessed for phonetic, visual and conceptual proximity

What you receive

A report when something relevant appears — not a monthly list of everything filed in your classes. Each notification states what was filed, by whom, in which classes, how close it is to your mark, when the opposition period closes, and what we recommend.

Most notifications need no action. The value lies in the ones that do, and in the fact that you learn about them with weeks in hand rather than after registration.

Why automated alerts are not enough

Database alerts match strings. They miss phonetic similarity across languages, transliterations, and figurative marks whose verbal element differs but whose overall impression does not. They also generate volume, which trains you to ignore them. Assessment by an attorney is the point of the service; the database query is the trivial part.

Scope

Watching can cover one mark or a portfolio, in Romania alone or across the EU. For clients with manufacturing operations here and marks registered elsewhere, watching Romania specifically is often the gap that has been overlooked.
